Welcome to TalkLivs. These Terms of Use (“Terms”) set out the rules that apply when you access or use the TalkLivs website and the communication features available through it (together, the “Platform”). The Platform is operated to help people start conversations and stay in touch with others online.

Please read these Terms carefully. By creating an account, accessing the Platform, or using any of its features, you confirm that you have read, understood, and agreed to be bound by them. If you do not agree with any part of these Terms, you should not use the Platform.

1. Who May Use the Platform

To use TalkLivs, you must be at least 18 years old and legally able to enter into a binding agreement under the laws that apply to you. By using the Platform, you confirm that you meet these conditions. Accounts that are found to belong to anyone under the required age may be suspended or closed.

You also agree that you will use the Platform only for lawful purposes and in line with these Terms. If you are using TalkLivs on behalf of an organisation, you confirm that you have the authority to accept these Terms for that organisation.

2. Your Account

To use most features, you will need to register and create an account. When you do, you agree to provide information that is accurate and to keep it up to date. You are responsible for the activity that takes place under your account, so please keep your login details private and do not share them with anyone.

If you believe that someone has accessed your account without your permission, let us know promptly through the contact page at https://talklivs.com/reach-us/. The Platform takes measures to help keep accounts secure, but you remain responsible for protecting your own credentials.

We may, at our discretion, refuse registration, or suspend or close an account where we reasonably believe these Terms have been breached.

3. How You May Use the Platform

TalkLivs is built for friendly, respectful communication. When you use the Platform, you agree that you will not:

  • Post, send, or share content that is unlawful, abusive, harassing, threatening, hateful, or that targets anyone based on attributes such as race, ethnicity, religion, gender, disability, age, or background;
  • Share content that is sexually explicit, that depicts or promotes violence, or that is otherwise harmful or offensive;
  • Impersonate any person or organisation, or misrepresent your identity or affiliation with anyone;
  • Send spam, chain messages, advertising, or any unsolicited promotional material;
  • Attempt to collect, store, or misuse other people’s personal information;
  • Upload viruses, malicious code, or anything designed to interfere with the Platform or other users’ devices;
  • Attempt to gain unauthorised access to the Platform, other accounts, or connected systems;
  • Use automated tools, bots, or scrapers to access or copy content from the Platform; or
  • Use the Platform in any way that breaks the law or infringes the rights of others.

We want every person on TalkLivs to feel comfortable. If you come across behaviour or content that you find unacceptable or suspicious, you can report it, and the Platform works to review reports and remove content that breaks these rules.

4. Content You Share

You keep ownership of the content you create and share on TalkLivs, such as messages, photos, and other materials (“Your Content”). By posting or sending Your Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, and transmit it for the limited purpose of operating and providing the Platform to you and the people you communicate with.

You are responsible for Your Content and confirm that you have the right to share it and that it does not breach these Terms or the rights of any third party. We do not claim ownership of Your Content, and the licence above ends when the content is removed, except where it has already been shared with others or where we need to retain it to meet a legal obligation.

We may review, restrict, or remove content that we reasonably believe breaches these Terms, though we are not obliged to monitor everything that is shared.

5. Our Content and Intellectual Property

The Platform itself — including its design, text, graphics, logos, software, and the TalkLivs name — is owned by us or our licensors and is protected by intellectual property laws. You may use it for your personal, non-commercial enjoyment of the Platform, but you may not copy, modify, distribute, sell, or create derivative works from any part of it without our written permission.

Nothing in these Terms transfers any of our intellectual property rights to you.

6. Paid Features

Some features on TalkLivs are available to use at no charge, while others are offered on a paid or premium basis. Where a feature carries a fee, the relevant cost and terms will be made clear before you choose to use it. By choosing a paid feature, you agree to pay the amount shown at the time of purchase.

Unless stated otherwise or required by applicable law, payments are processed through our payment providers and are non-refundable once the relevant feature has been delivered. Prices and the features that are available may change from time to time, and any changes will apply from the date they are published.

7. Privacy

Your privacy matters. The way we collect, use, and look after personal information is explained in our Privacy Policy, which forms part of these Terms. The Platform uses industry-standard security measures to help protect the information handled through it. By using TalkLivs, you agree to the handling of your information as described in the Privacy Policy.

8. Third-Party Links and Services

The Platform may contain links to third-party websites or services that we do not own or control. These links are provided for convenience only. We are not responsible for the content, policies, or practices of any third party, and accessing them is at your own risk. We encourage you to read the terms and privacy policies of any third-party service you use.

9. Suspension and Termination

You may stop using TalkLivs at any time and can request the deletion of your account through the contact page at https://talklivs.com/reach-us/.

We may suspend or end your access to the Platform, with or without notice, if you breach these Terms, if your use creates a risk to the Platform or to other people, or where we are required to do so by law. Where it is reasonable to do so, we will aim to let you know. Sections of these Terms that by their nature should continue after your access ends — such as those covering content licences, intellectual property, disclaimers, and limitation of liability — will remain in effect.

10. Availability of the Platform

We work to keep TalkLivs running smoothly, but we cannot promise that it will always be available, uninterrupted, or free of errors. From time to time we may need to update, change, suspend, or withdraw features for maintenance, improvement, or other operational reasons. We will try to limit any disruption, but we are not liable for periods when the Platform is unavailable.

11. Disclaimers

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties or guarantees about the Platform, including its reliability, suitability for a particular purpose, or the conduct of other users.

TalkLivs is a space for online communication. You are responsible for how you choose to interact with others, and you should use your own judgement and care when communicating with people you do not know.

12. Limitation of Liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence or for fraud.

Subject to that, to the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, data, goodwill, or opportunity, arising out of or in connection with your use of the Platform. Where we are found liable, our total liability to you will not exceed the greater of the amount you paid to us in the twelve months before the event giving rise to the claim, or one hundred pounds sterling (£100).

13. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, liabilities, and reasonable expenses (including legal fees) that arise out of your breach of these Terms, your misuse of the Platform, or your infringement of the rights of any other person.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Platform, the law, or how we operate. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, give you additional notice. Your continued use of the Platform after any update means that you accept the revised Terms. We encourage you to review this page from time to time.

15. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or your use of the Platform, are governed by and construed in accordance with the laws of England and Wales. You and we agree that the courts of England and Wales will have exclusive jurisdiction to settle any such dispute or claim, although if you live in another country, you may also be entitled to bring proceedings in the courts of your home country where applicable law allows.

16. General

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply in full. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with our Privacy Policy, make up the entire agreement between you and us regarding your use of the Platform. You may not transfer your rights or obligations under these Terms without our consent, while we may transfer ours where the new party agrees to uphold them.
